How overtime works in Washington

1 · The weekly 40 hour rule

Washington overtime law mirrors the federal Fair Labor Standards Act: nonexempt employees earn at least 1.5 times the regular rate for hours over 40 in a workweek. There is no Washington state daily overtime trigger.

2 · The $17.13 minimum wage

Washington adjusts its minimum wage for inflation every January 1. For 2026 the rate is $17.13 an hour for workers 16 and older. The state bans tip credits, so tipped workers earn the full rate before tips.

3 · Local rates can be higher

Seattle, SeaTac, Tukwila, Renton, Everett, Bellingham, Burien and unincorporated King County all set higher local minimums. Seattle pays $21.30 an hour in 2026 for all employers. You are owed the highest rate that applies to you.

The Washington formula (federal style math)
Gross = (40 × rate) + (hours over 40 × rate × 1.5)

Washington specifics worth knowing

No Washington state income tax. Like Florida and Texas, Washington has no income tax at all, so your overtime premium is reduced only by federal income tax and Social Security and Medicare taxes. A dollar of overtime premium stretches further here than in Oregon or Minnesota.

The exempt salary floor is high. Washington sets its own overtime exempt salary threshold at 2.25 times the minimum wage: $80,168.40 a year in 2026, far above the federal $35,568. A salaried worker under that line is generally nonexempt and owed overtime.

No tip credit, ever. Washington employers must pay tipped workers the full minimum wage before tips. A Seattle server earns at least $21.30 an hour in base pay, plus tips on top. Compare that with our New York overtime calculator, where tip credits still apply.

The federal baseline is explained in the FLSA overtime rules guide. For a state with daily overtime instead, see the California overtime calculator.

Common mistakes

Mistake 1: Expecting daily overtime after 8 hours. Washington has no daily overtime trigger. A 12 hour shift earns nothing extra unless the week passes 40 hours. Budget like a Texan, not a Californian.
Mistake 2: Using the 2025 rate of $16.66. The minimum wage rose to $17.13 on January 1, 2026. Any 2026 payroll or budget still built on $16.66 underpays every minimum wage hour.
Mistake 3: Missing the local rate. Work inside Seattle city limits and the floor is $21.30, not $17.13. Tukwila is $21.65 and SeaTac $20.17. Employers must pay the highest rate that applies to the work location.
Mistake 4: Assuming a tip credit lowers tipped pay. Washington bans tip credits entirely. A tipped employee owed $17.13 gets $17.13 in wages, and tips stack on top. Deducting a tip credit is a wage violation here.
